4. Legal Basis for Processing (EEA, UK, Switzerland)
If you are located in the European Economic Area (EEA), United Kingdom, Switzerland, or similar jurisdictions, we collect and process your personal information based on one or more of the following legal bases:
- Performance of a Contract: To provide you with the services you have signed up for.
- Legitimate Interests: When we have a legitimate business interest, such as improving our services, preventing fraud, or ensuring network security — balanced against your rights and freedoms.
- Consent: When you have explicitly consented to processing for one or more specific purposes (such as analytics or marketing cookies).
- Legal Obligation: When we need to process your data to comply with a legal obligation under EU, UK, Swiss, or Czech law.
5. Data Sharing and Disclosure
We do not sell your personal information. We may share your personal information in the following circumstances:
5.1 Third-Party Service Providers
We share information with carefully selected service providers who help us operate our business and deliver services to you. These include:
- Payment processing: Epoch (epoch.com) — acts as our merchant of record; handles all card transactions; subject to PCI-DSS
- Age verification: AgeVerif (ageverif.com) — for visitors in jurisdictions that require age verification (UK Online Safety Act, US state laws, EU implementations). AgeVerif is the controller of any identity documents you submit; we receive only a pass/fail signal. See §15 for details.
- Affiliate program: NATS (nats.sexbabesvr.com)
- Analytics: Google Analytics 4 with IP anonymization (only after consent via our cookie banner)
- Consent management: Klaro (open-source library, self-hosted on our servers — your consent choices are stored locally on your device and are not transmitted to a third party)
- Hosting and CDN providers for content delivery and Site availability
- Customer support tooling for ticket handling and email correspondence
- Fraud prevention and security services
These service providers are contractually bound to use personal information only for the purposes for which we disclose it to them, and to maintain confidentiality and appropriate security measures.
5.2 Affiliates and Business Partners
We may share certain information with our affiliates (companies under common ownership or control) and business partners who offer joint promotions or products. Where required by applicable law, we will obtain your consent before sharing your information for these purposes.
5.3 Legal Requirements
We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency request). We may also disclose your information to:
- Enforce our Terms & Conditions and other agreements
- Protect and defend our rights or property
- Prevent or investigate possible wrongdoing in connection with the Site
- Protect the personal safety of users of the Site or the public
- Protect against legal liability
5.4 Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of company assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.
6. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. The criteria used to determine our retention periods include:
- The length of time we have an ongoing relationship with you (e.g., active membership)
- Our legal obligations under EU, Czech, US state, and other applicable law (including tax record retention and 18 U.S.C. § 2257 record-keeping where applicable)
- The nature and sensitivity of the data
- The potential risk of harm from unauthorized use or disclosure
- Whether we can achieve the purposes through alternative means, such as anonymization
When we no longer require personal information, we securely delete or irreversibly anonymize it. Account data is typically retained for 24 months following account closure for fraud-prevention and legal-defense purposes, after which it is deleted or anonymized.
7. Your Privacy Rights
Depending on your location, you have certain rights regarding your personal information.
7.1 Rights Available to All Users
- Access: You may request access to your personal information we hold.
- Correction: You may request that we correct inaccurate personal information.
- Marketing Preferences: You can opt out of marketing communications at any time via the unsubscribe link in any marketing email, your account settings, or by contacting us directly.
7.2 EEA, UK, and Swiss Residents (GDPR / UK GDPR / Swiss FDPA)
Under the EU General Data Protection Regulation, the UK GDPR, and the Swiss Federal Act on Data Protection, you have additional rights, including:
- Right to Erasure (“Right to be Forgotten”): Request deletion of your personal information.
- Right to Restrict Processing: Request that we restrict processing of your personal information in certain circumstances.
- Right to Data Portability: Receive your personal information in a structured, commonly-used, machine-readable format and have it transmitted to another controller.
- Right to Object: Object to our processing of your personal information based on legitimate interests or for direct marketing.
- Right to Withdraw Consent: Withdraw consent at any time where we rely on consent as our legal basis — without affecting the lawfulness of processing carried out before withdrawal.
7.3 US State Residents
If you are a resident of California, Virginia, Colorado, Connecticut, Utah, or other US states with comprehensive privacy laws, see §16 (US State Privacy Rights) for the detailed rights available to you.
7.4 Verification Process
To protect your privacy, we may need to verify your identity before processing your request. This usually means asking you to confirm specific information already on file (such as the email address associated with your account).
7.5 Authorized Agent
You may designate an authorized agent to make a request on your behalf. When using an authorized agent, we may require proof of the agent's authorization to act for you, in addition to verification of your own identity.
7.6 Response Time
We will respond to verifiable consumer requests within the time required by applicable law — generally 30 days for GDPR/UK GDPR, 45 days for CCPA/CPRA (with possible 45-day extension upon notice).
8. Data Security
We implement appropriate technical and organizational measures to protect your personal information against unauthorized or unlawful processing, accidental loss, destruction, or damage. These measures include:
- Encryption of sensitive data in transit (TLS) and at rest where applicable
- Regular security assessments and patching
- Access controls limiting personal data to staff with a legitimate need
- Secure network architecture and segmentation
- Employee training on data protection and confidentiality
- PCI-DSS compliance for payment-card data (handled by our processor)
However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
9. International Data Transfers
We are based in the Czech Republic and operate globally. When you use our Site, your information may be transferred to, stored, or processed in countries outside your country of residence, including countries that may not have the same data protection laws as the country in which you reside.
For transfers from the EEA, UK, or Switzerland to countries not deemed to provide an adequate level of data protection, we implement appropriate safeguards, including:
- Standard Contractual Clauses (SCCs) as approved by the European Commission (Decision 2021/914)
- UK International Data Transfer Addendum to the EU SCCs, or the UK International Data Transfer Agreement (IDTA), where the UK GDPR applies
- Swiss FDPA equivalents for transfers from Switzerland
- Supplementary technical measures (encryption, pseudonymization) where the importing country's surveillance laws warrant them, in line with the Schrems II ruling
You may request a copy of the relevant safeguards by contacting us at info@sexbabesvr.com.
10. Third-Party Links and Services
Our Site may contain links to third-party websites, products, or services (for example, our affiliate program at nats.sexbabesvr.com, our payment processor at epoch.com, or social platforms linked from our footer). These third parties have separate and independent privacy policies. We have no responsibility or liability for the content or activities of these linked sites. Nonetheless, we welcome any feedback about them.
11. Do Not Track Signals
Some browsers transmit a “Do Not Track” (DNT) signal. Due to the lack of an industry-wide standard for interpreting DNT, our Site does not currently respond to DNT signals. We do, however, honour your choices made through our cookie consent banner, your account preferences, and the Global Privacy Control (GPC) signal where applicable under US state laws.
12. User-Posted Content (Comments & Ratings)
The Site allows registered users to post comments and ratings. The Site does not currently offer any feature for users to upload audiovisual or media files — all scenes, photos, and videos available on the Site are produced by us or our licensors. This Privacy Policy does not apply to information contained in, or ascertainable from, the content you choose to post publicly. By posting publicly, you waive any claim to privacy rights in connection with information contained in your post. Do not include personal information you wish to keep private in your comments or ratings.
13. Children & Minors
Our Site is intended exclusively for adults and is strictly not directed to children under 18 years of age. We do not knowingly collect personal information from children under 18. We comply with the United States Children's Online Privacy Protection Act (COPPA), which prohibits the knowing collection of personal information from children under 13, and we extend that protection to all minors under 18 given the adult-content nature of the Site.
If you are a parent or guardian and believe that your child has provided us with personal information, please contact us at info@sexbabesvr.com. If we discover that a minor under 18 has provided us with personal information, we will promptly delete the information from our systems and terminate the associated account.
14. Cookies & Tracking
14.1 What Are Cookies
Cookies are small text files placed on your device when you visit a website. They are widely used to make websites work efficiently, remember your preferences, and provide information to website owners.
14.2 How We Use Cookies
- Essential cookies: Required for the Site to function (login state, cart, security). These cannot be disabled.
- Preference cookies: Remember your preferences (language, layout, playback choices).
- Analytics cookies: Help us understand how visitors interact with our Site (Google Analytics 4 with IP anonymization). Loaded only after consent.
- Marketing cookies: Track browsing habits to deliver targeted advertising. Loaded only after consent.
14.3 Our Consent Management Platform (Klaro)
We use Klaro, an open-source consent management platform, to give you granular control over which non-essential cookies and tracking technologies run on your visit. The Klaro library is self-hosted on our servers — your consent choices are stored locally in your browser and are not transmitted to any third-party consent vendor.
On your first visit, a banner appears at the bottom of the screen letting you Accept All, Decline, or open a detailed modal where you can toggle individual categories (analytics, marketing) on or off. Until you make a choice, all non-essential cookies remain blocked — we operate on a deny-by-default basis using Google's Consent Mode v2 to ensure analytics and marketing tags do not fire without your consent.
14.4 Changing or Withdrawing Your Cookie Consent
You can change your choices at any time. The simplest way is to clear cookies for sexbabesvr.com in your browser, which will cause our banner to reappear on your next visit. You may also reach out to us at info@sexbabesvr.com for help managing your preferences.
14.5 More Information About Cookies
To find out more about cookies generally, including how to view and delete them, visit www.allaboutcookies.org. To opt out of Google Analytics across all websites, visit tools.google.com/dlpage/gaoptout.
15. Age Verification
A growing number of jurisdictions require adult-content services to verify, with high confidence, that visitors are at least 18 years of age before granting access to explicit material. These include the United Kingdom (Online Safety Act 2023), the European Union (national implementations), and a number of US states with adult-content age-verification statutes (currently including Louisiana, Texas, Utah, Mississippi, Virginia, Arkansas, Montana, North Carolina, Indiana, Kansas, Tennessee, Florida, Alabama, and others as those laws come into effect).
15.1 Our Age-Verification Provider (AgeVerif)
For visitors in jurisdictions that require age verification, we use AgeVerif (ageverif.com) as our independent third-party age-assurance provider. Where verification is required, you will be redirected to AgeVerif's secure flow before being granted access to age-restricted Content.
AgeVerif is the controller of any identity documents, biometric data, or verification information you submit during the verification flow. AgeVerif processes that data under its own privacy policy, available on the AgeVerif website. We have no access to those documents or the underlying personal data.
15.2 What We Receive and Retain
We receive only a pass/fail verification signal (and, in some cases, an opaque verification token tied to your visit or Account). We do not store identity documents, photographs of identity documents, or biometric data on our systems. Where we store a verification token, it allows us to recognize that you have already passed verification so you do not have to repeat the flow on every visit. Tokens are retained only as long as necessary to comply with the relevant jurisdiction's requirements and our security needs.
15.3 Geographic Application
Age verification is triggered based on the country (and, in the US, the state) we detect from your IP address or other location signals. If you access our Site from a jurisdiction where verification is mandatory and you do not complete the verification flow, you will not be able to view age-restricted Content.
15.4 Content Moderation, Reporting, and Transparency
In addition to age verification, we maintain content-moderation processes and reporting mechanisms to address illegal content and content harmful to children. Information about our content standards, moderation, and removal procedures is available via our Terms & Conditions and Content Removal page.
15.5 Complaints and Inquiries
If you have a complaint or query about our age-verification practices or our compliance with the UK Online Safety Act, US state laws, or any other jurisdictional requirement, please contact us at info@sexbabesvr.com. UK users may also raise concerns with the UK regulator, Ofcom. Residents of US states with applicable age-verification statutes can typically raise concerns with their state attorney general's office.
16. US State-Level Privacy Rights
If you are a resident of a US state with a comprehensive privacy law (currently including California, Virginia, Colorado, Connecticut, Utah, and others as those laws come into effect), you have specific rights regarding your personal information.
16.1 California (CCPA / CPRA)
Under the California Consumer Privacy Act and California Privacy Rights Act, California residents have the right to:
- Know: Request information about the personal information we collect, use, disclose, and share.
- Delete: Request deletion of personal information we have collected from you, subject to legal exceptions.
- Correct: Request correction of inaccurate personal information.
- Opt-Out of Sale or Sharing: Opt out of the “sale” or “sharing” of your personal information for cross-context behavioral advertising. We honour the Global Privacy Control (GPC) signal as a valid opt-out.
- Limit Use of Sensitive Personal Information to specified purposes.
- Non-Discrimination: Receive equal service and pricing even when you exercise your privacy rights.
Categories of personal information collected: identifiers (name, email, IP), commercial information (purchases), internet activity (browsing history on the Site), and approximate geolocation derived from IP.
Sources: directly from you, automatically when you use our Site, and from third-party service providers (e.g., payment processor confirmations).
Sale or sharing: we do not “sell” personal information as that term is traditionally defined, but we may “share” certain identifiers with advertising partners for cross-context behavioral advertising. To opt out, use the cookie consent banner, send a GPC signal from your browser, or contact us at info@sexbabesvr.com.
16.2 Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA)
Residents of Virginia, Colorado, Connecticut, and Utah have rights similar to those of California residents under the Virginia Consumer Data Protection Act, Colorado Privacy Act, Connecticut Data Privacy Act, and Utah Consumer Privacy Act respectively. These typically include the rights to access, correct, delete, obtain a portable copy of, and opt out of targeted advertising or the sale of personal data.
To exercise any of these rights, contact us at info@sexbabesvr.com. If we deny your request, you have the right to appeal — we will respond to appeals within the time required by your state's law.
16.3 Nevada
Nevada residents have the right to opt out of the sale of certain “covered information” to third parties under Nevada Revised Statutes Chapter 603A. We do not sell covered information as defined by Nevada law. To make an inquiry regarding your Nevada rights, contact us at info@sexbabesvr.com.
16.4 Other US States
As additional US state privacy laws come into effect, we will update this section to reflect newly available rights. In the meantime, residents of any US state may contact us for the rights available under applicable law.
